Judge authorizes payment of R$ 40 million to Busscar labor creditors

Judge Edson Luiz de Oliveira, of the 5th Civil Court of the district of joinville, authorized the release of R$ 40 million to pay Busscar's labor creditors. Each worker will receive, at most, up to R$ 50 thousand.

However, this value will probably only serve creditors classified in the non-bankruptcy category. The decision is from February 20, 2020.

Therefore, the amount corresponding to each of the creditors will be transferred, by court order, to the account of the trustee, by the Judge of Joinville.

For the start of payments immediately after, a total period of 60 consecutive days is set, counting from the date of the decision.

Any balance, at the end of the term, must be immediately collected by the trustee in favor of the bankrupt estate for later use in a new apportionment or payment of creditors.

After all, information and guidance can be obtained directly from the trustee, who has observed the debtor's ability to pay.

The magistrate, in line with his decision, also argues that, after due diligence, “it was observed that there are financial resources, in judicial deposit, (kind), which support, in priority, a large portion of labor claims.

These already recognized and regularly qualified, which are known to fall into the category of extra public tender.”

The judge recalls that previously the possibility of apportionment had been recognized, and, on that occasion, the payment of approximately 30% was defined and disciplined.

Meanwhile, Busscar, which was once one of the main bus manufacturers in Brazil. It had its heyday in the 80s and 90s of the last century.

Declined after the death of patriarch and founder Harold Nielson. Helped by the BNDES in 2004, it entered an acute crisis from 2008 onwards, from which it never emerged.

In 2011, it entered into judicial recovery and had its bankruptcy declared.

As for each of the labor claims, what remained attended and fulfilled by the trustee.

Busscar was declared bankrupt in September 2014. However, it was one of the most important bus manufacturers in Brazil, with international prominence. The activities ended in 2012.
