Codesp, after a meeting with the Federal Public Ministry, cancels the tender opened in 2017 by recognizing several irregularities.
The Companhia Docas do Estado de São Paulo (Codesp) canceled a tender opened in 2017 for new vacancies at the state-owned company. The company recognized irregularities during the event. The decision was reached after a meeting with representatives of the Federal Public Prosecutor's Office, which had already manifested itself in court for the suspension of the selection process in a public civil action.
Codesp declared that the registration fees paid by the candidates will be refunded and the functional bonds that may have been signed with those approved in the contest will be cancelled.
Annulment of the tender
The Federal Public Ministry said it had already forwarded a petition to the 1st Federal Court of Santos requesting that the annulment of the event be ratified.
According to the Public Prosecutor's Office, the selection process presented illegal criteria for the verification commission of self-declared racial profiles, which led to the disqualification of quota candidates. At least 56 people would have been harmed.
At first, Codesp denied the flaws in the tender and obtained a court decision to refer the action to the State Justice, claiming the Union's lack of interest in the case. The case was forwarded to the Superior Court of Justice (STJ) after the Federal Public Ministry appealed.
Only in May of last year, changes in the company's statute made it possible for the 1st Federal Court of Santos to finally recognize its competence to judge the case and proceed with the procedure.
“Procedural acts, especially decision-making ones, will be carried out by an absolutely incompetent Court, making the declaration of nullity of such acts inescapable”. Said the attorney, Ronaldo Bartolomazi, referring to possible decisions at the state level for the annulment of the competition.
The attorney also warned that the submission of the records could generate irreversible consequences due to the conclusion of the event and the imminence of hiring those approved.
