Rio City Hall removes equipment from a deactivated hospital to use in the municipal health network. The reason is the fight against the coronavirus.

Na última quinta-feira (2), a Prefeitura do Rio adotou uma medida nunca vista até então para enfrentar a  luta contra o coronavírus: retirou de um hospital privado desativado, equipamentos médicos para usá-los na rede de saúde do município. O Hospital foi o Espanhol, no Centro da cidade que se encontra parado e foi oferecido à Prefeitura em troca de um aluguel.

However, technicians evaluated and it was concluded that the structure did not have sanitary conditions. Thus, the state government asked only for the equipment, which was denied by the owners. For this reason the municipality decided to take the goods and pay for them later – in case of damage.

In the legal environment, this measure is called “administrative requisition” and is provided for in municipal, state and federal public calamity decrees. Private goods can be removed and used by the state when necessary, with eventual compensation later.

Situation in the pandemic

The opinion signed by the chief prosecutor of the administrative prosecutor's office in Rio, Arícia Fernandes Correia, states that there are doubts about whether "there will be equipment for everyone" in the midst of the current pandemic scenario, which would justify the measures taken. “It is a rare hypothesis – not least because a pandemic of this proportion is unique in history”, says Arícia in the document.

The chief prosecutor also says that the hospital's refusal to provide the equipment is unjustifiable: "Since there is empirical evidence of what could happen to those affected by the disease if the public network does not have the infrastructure and equipment capable of taking care of its patients ”.

In an inventory, the city requested: 90 beds; 9 respirators (6 in good condition) and 15 multi-parameter monitors.

Hospital Ronaldo Gazolla and Hospital de Campanha do Rio Centro will receive the most serious cases of covid-19 infection and thus receive the first machines and supplies. Other equipment at the Spanish Hospital is being evaluated.
